Most people don’t know how to attack a Spring DWI case.  Did the officer have a legal reason to pull you over?  Did the officer proper administer the Field Sobriety Tests?  Did the officer properly take blood or did they coerce you to give breath or blood?  Was there a warrant involved and was it valid?  Are the breath or blood results valid?  Did the machine that tested my blood/breath malfunction?

What most people don’t know is that you can get a Spring DWI for taking your prescription medication and driving.  It’s a common misperception.  Providing a doctor’s prescription to the prosecutor doesn’t get you out of the Spring DWI conviction.

Typically, your first Spring DWI will be a class B misdemeanor (range of punishment 3 days up to 180 days in jail and up to $2,000 fine).  However, on September 1, 2011, the Texas legislature amended the Spring DWI law for those people who have a blood alcohol concentration over .15 mg/L will be charged with a class A misdemeanor, which increases the range of punishment to up to 1 year in jail and $4,000 fine.  If this is your second Spring DWI, you will also be charged with a class A misdemeanor, but this can increase the minimum punishment to 30 days in jail.   However, often the government is not able to locate your prior judgments and your case could be reduced to a class B.  If you have more than two Spring DWI's, you are facing a 3rd degree felony (even if your 1st DWI was 30 years ago).  With a felony you are looking at a prison sentence from 2-10 years.
